1. Information We Collect

1.1 User Account Information


When you create an account to use certain features of HueBuddy, we may collect:


  • Email address - used for account identification, login, password recovery, and communications.

  • Authentication data - passwords (securely hashed), tokens or other credentials needed to verify your identity.


These data are required to provide account-based services (e.g. synchronising your palettes across devices).


1.2 Palette Data

When you create, save, or upload palettes, we may collect the following palette-related data:

• Images associated with palettes

• Colour / swatch data (RGB/HEX or other colour representations)

• Palette names, metadata, and tags

• Timestamps (creation, last updated)


1.3 Usage and Log Data

We may record log data and usage metrics (e.g. which features you use, timestamps, device type, operating system version). This data is anonymised or pseudonymised and used for improving our Service, debugging, and analytics.


1.4 Third-Party Services

We use third-party services to power parts of the Service. In particular:


• Supabase - for database storage, user authentication, and related backend functionality.


The third-party providers will have access only to the data necessary to perform their functions, under confidentiality constraints.


2. How We Use the Information

We use your information for the following purposes:


• To provide, maintain, and improve the Service

• To authenticate and identify you and manage your account

• To store, synchronise, and retrieve your palettes and associated data

• To respond to your requests, including support inquiries

• To monitor and analyse usage trends, detect and prevent fraud, abuse, or security issues

• To send you administrative or transactional messages (e.g. password reset, account
confirmations)

• To comply with legal or regulatory obligations


3. Data Storage, Security & Sharing


3.1 Data Storage

Your data (account info and palette data) is stored securely in the cloud via Supabase. Data is stored in encrypted form at rest and transmitted over secure (TLS/SSL) connections.

3.2 Security


We implement reasonable administrative, technical, and physical safeguards to protect your data against unauthorised access, disclosure, alteration, or destruction. Examples include:

• Encryption of data in transit (TLS)

• Encryption of sensitive fields at rest

• Access controls and authentication to restrict internal access

• Regular security assessments and audits


However, no system is 100% secure. We cannot guarantee absolute security of your data.


3.3 Data Sharing / Disclosure

We do not sell, rent, or trade your personal data or palette data to third parties for marketing or commercial purposes.

We may share your information only in the following limited circumstances:

• With third-party service providers (e.g. Supabase) under contract, only to the extent necessary to provide the Service

• To comply with legal processes (court orders, subpoenas) or governmental requests

• To enforce our terms and protect our rights, property, or safety (including those of users)

• In connection with a merger, acquisition, or sale of assets (with appropriate safeguards)

In all cases, we require recipients to maintain confidentiality and only use data for permitted purposes.

3.4 Aggregated / Anonymised Data

We may aggregate or de-identify data (e.g. usage trends) and use or share it without restriction, so long as it cannot reasonably identify an individual user.

4. Your Rights and Choices

Depending on your jurisdiction, you may have certain rights regarding your personal data. Here is how you can exercise them with HueBuddy:

4.1 Access / Correction


You can access and review your account and palette data via the app or website. You may correct or update any information (e.g. palette names, images, etc.).


4.2 Deletion (“Right to be Forgotten”)

You may choose to delete your account and all associated data. Upon such a request:

• We will permanently delete your account information, palette data, and associated metadata (unless we are legally obligated to retain some data).

• Backups may persist for a limited time due to technical constraints but will be purged in accordance with our data retention policy.

4.3 Portability

You may request a machine-readable export of your palette data (images, colour values, names, metadata).

4.4 Opt-Out / Restrict Processing

Where applicable, you may opt out of certain analytics or profiling. Note: opting out may limit some features of the Service.

4.5 Withdraw Consent

Where our processing is based on consent, you may withdraw your consent at any time (without affecting processing done prior to withdrawal).

4.6 Complaints and Regulatory Rights

If you believe we are misusing your data, you may lodge a complaint with your local data protection authority.



5. Children’s Privacy


Our Service is not intended for children under the age of 13 (or the applicable minimum age in your jurisdiction). We do not knowingly collect personal information from children. If we learn we have collected such data, we will take steps to delete it.


5. Changes to This Privacy Policy


We may update this Privacy Policy from time to time (e.g. due to new features or legal requirements). When we do:

• We will revise the “Effective Date” at the top

• We will notify you (e.g. via email or in-app notification) if changes are material

• Continued use of the Service after changes constitutes your acceptance of the revised Policy

Welcome to HueBuddy (“App”, “Service”, “we”, “our”, or “us”). These Terms of Use govern your access to and use of the HueBuddy mobile application and related services.


By downloading, accessing, or using HueBuddy, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.


1. Description of Service


HueBuddy is a colour analysis and paint-mixing assistance application designed to help artists identify colours and create paint mixing suggestions from images.


The App is provided for informational and creative purposes only. Color suggestions and paint mixing recommendations may vary based on paint brands, lighting conditions, device displays, and other factors.


2. Eligibility


You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the App.


3. Subscriptions and Purchases


HueBuddy offers optional premium features through HueBuddy Pro.


HueBuddy Pro Plans


  • Monthly Subscription: $3.99 USD per month

  • Annual Subscription: $24.99 USD per year

  • Lifetime Access: $49.99 USD one-time purchase


Prices may vary by region, currency, taxes, and App Store pricing policies.


Automatic Renewal


Monthly and Annual subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.


Your Apple Account will be charged for renewal within 24 hours prior to the end of the current subscription period.


Managing Subscriptions


You can manage or cancel your subscriptions through your Apple App Store account settings.


Refunds


All purchases are processed through Apple. Refund requests are subject to Apple’s refund policies and procedures.


4. License


We grant you a limited, non-exclusive, non-transferable, revocable license to use HueBuddy for personal, non-commercial purposes in accordance with these Terms.


You may not:


  • Copy, modify, or distribute the App;

  • Reverse engineer or attempt to extract source code;

  • Use the App in a manner that violates any applicable law;

  • Interfere with the operation or security of the Service.


5. Intellectual Property


The App, including its design, features, software, logos, trademarks, content, and technology, is owned by HueBuddy and protected by intellectual property laws.


All rights not expressly granted are reserved.


6. User Content


You may upload or analyse images through the App.


You retain ownership of any images you provide. By using the App, you grant us the rights necessary to process those images solely for providing the Service.


You represent that you have the necessary rights to any content you upload.


7. Disclaimer of Warranties


HueBuddy is provided on an “AS IS” and “AS AVAILABLE” basis.


We make no warranties regarding:


  • Accuracy of colour matching;

  • Accuracy of paint mixing suggestions;

  • Availability or uninterrupted operation of the App;

  • Compatibility with all devices or paint products.


To the maximum extent permitted by law, all warranties are disclaimed.


8. Limitation of Liability


To the fullest extent permitted by law, HueBuddy and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.


Our total liability for any claim relating to the Service shall not exceed the amount paid by you for the Service during the twelve months preceding the claim.


9. Changes to the Service


We may modify, suspend, or discontinue any part of the Service at any time without prior notice.

We may also update these Terms from time to time. Continued use of the App after changes become effective constitutes acceptance of the revised Terms.


10. Termination


We reserve the right to suspend or terminate access to the Service if you violate these Terms or misuse the App.


11. Privacy


Your use of HueBuddy is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.


12. Governing Law


These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to conflict of law principles.

14. Apple App Store Terms


If you obtained the App through the Apple App Store:


  • Apple is not responsible for the App or its content.

  • Apple has no obligation to provide maintenance or support services.

  • Apple is a third-party beneficiary of these Terms and may enforce them against you.

  • Your use of the App must comply with applicable App Store terms and policies.


By using HueBuddy, you acknowledge that these Terms are between you and HueBuddy, and not with Apple.
